Indonesian Patent Update – New Year, New Extension of Time to Settle the Unpaid Patent Annuity

Dear friends and colleagues, The Indonesian Patent Office has announced another extension to settle the outstanding patent annuity to July 31, 2020. However, the extension is only valid for those who have previously provided an undertaking which states the commitment to pay the unpaid annuity fee. The deadline to submit the undertaking is January 31, 2020. This is not the first time the Indonesian Patent Office provided an extension of time to settle the unpaid patent annuity. Nevertheless, we strongly advise our clients to immediately settle the unpaid annuity in order to maintain or continue the prosecution of the pending patent applications in Indonesia. Failure to do so will also affect the eligibility of the applicants to file patents in Indonesia in the future. Kenapa 24% Pendaftaran Merek di Indonesia Ditolak?

Berdasarkan informasi yang dilansir oleh Direktorat Jenderal Kekayaan Intelektual, Kementrian Hukum dan HAM Republik Indonesia, setidaknya ada 34 ribu permohonan Merek dari 139 ribu lebih permohonan Merek yang ditolak. Adapun alasan-alasan dari penoloakan tersebutyang paling umum adalah sebagai berikut:   1. Memiliki Persamaan Pada Pokoknya/Secara Keseluruhan Dengan Merek Terdahulu Dasar penolakan yang paling umum menurut pengalaman kami adalah permohonan Merek yang diajukan memiliki persamaan pada pokoknya atau secara keseluruhan dengan Merek yang sudah diajukan terlebih dahulu. Resiko penolakan ini dapat diminimalisir dengan berbagai cara, di antaranya adalah dengan melakukan penelusuran Merek sebelum pengajuan Merek di Direktorat Jenderal Kekayaan Intelektual Indonesia.   2. Merek Terlalu Desktriptif Suatu Merek akan ditolak apabila terlalu deskriptif. Cotohnya, Anda mengajukan Merek “KOPI” untuk jenis barang di Kelas 30 yang mencakup “biji kopi” maupun jenis jasa di Kelas 43 yang mencakup “kedai kopi”. Suatu Merek harus memiliki nilai kekhususan agar dapat diterima permohonan pendaftarannya.   3. Memuat Info Menyesatkan Menurut pengalaman kami, ada beberapa permohonan Merek yang menggunakan kata-kata superlative seperti “SUPER”, “POWERFUL”, “THE BEST” yang ditolak oleh Direktorat Jendetal kekayaan Intelektual. Menurut pemeriksa, kata-kata tersebut dapat saja menyesatkan konsumen!   Yuk, kita hindari kesalahan-kesalahan di atas sebelum mengajukan permohonan Merek di Indonesia dan di luar negeri. This sudden announcement was issued on April 29, 2019 and there are several fees that have increased, among others, patent substantive examination fees, recordal fees, patent maintenance fees, and Madrid Registration fees. MYANMAR: TRADEMARK AND INDUSTRIAL DESIGN LAWS HAVE BEEN ENACTED

After years of waiting, we are pleased to update you that Myanmar new Trade Marks Law and Industrial Design Law have been enacted on 30th January, 2019.   In Trademark Law, there are many significant provisions differed from current practice for the applicant and needs to note the changes since Trade Marks Law is adopting “first-to-file” system instead of “first-to-use” which is currently practicing in trademark registration and all registered trademarks are required to be reregistered in accordance with the new Trade Marks Law to obtain the right given under the new Law.   Following provisions are some highlights of Trade Marks Law for your quick reference: Applicant can claim the priority right and exhibition priority right together with sufficient document and description. If applied mark has been registered at the Office of the Registrar of Deeds, aforesaid registered document is required to be attached. Earliest applicant, who submits the application conformed to specifications, shall have the right to register the Mark if there is dispute to register for same or similar trademarks in different days by more than one person. A person can, who wishes to object regarding the application for the registration of mark, submit the opposition to the Registrar by paying specified fee for any reason mentioned in respective sections within 60 days from the date of announcement. Term of registered Mark shall be (10) years and renewal can be made for 10 years in each time after the expiration of first registration period. Mark owner shall apply to renew the term of registration by paying specified fee within (6) months before expiration date of registration period. Proprietor can apply the case at Intellectual Property Court to make the order of temporary action in accordance with relevant provisions of this Law by means of civil suit for his damage. Proprietor can apply to the Intellectual Property Court to take either criminal or civil action. The owner of the Mark which has been registered at the Office of the Registrar of Deeds in accordance with the Registration Act before enforcement of the Trade Marks Law (OR) the owner who is actually using the Mark in local market shall submit the application for the registration of the mark in accordance with this law if he wants for the right of registered mark. Notwithstanding anything contained in other existing law, Trademark registration shall be carried out in accordance with Trade Marks Law.   Further, although Trademark Law is enacted, according to the provision, the law shall come into force commencing from the day, by notification, issued by the President of the Union. Therefore, the Law is unimplementable at the moment and for the time being applicant can file the Trademark application at the Office of the Registrar of Deeds by submitting the “Declaration of Ownership of Trademark” together with required documents requested by the Office of the Registrar of Deeds and in accordance with the Deeds of Registration Law.   Should you have any question regarding Trademark and Industrial Design in Myanmar, please contact us at [email protected].  

Settle the outstanding annuities, or no new patent filings will be allowed – the DGIP’s latest move to ensure all debts are settled

In the past few days, the Directorate General of Intellectual Property of the Republic of Indonesia (the DGIP)  has sent notices to foreign patent owners with regard to the patent holders’ obligations to pay the outstanding annuities within 6 months. Failure to pay up the ‘debt’ caused by the outstanding annuities will result in the refusal of new patent applications.  This surprising move by the DGIP has made several patent holders wondering whether the payment of the outstanding annuities will actually have any effect for the future patent applications by the patent holders. Ingin Mendaftarkan Merek di Amerika Serikat? Baca Ini Terlebih Dahulu

Namun sebelum Anda melakukan hal tersebut, ada beberapa pilihan yang harus diperhatikan mengenai “Filing Basis“. Di Amerika Serikat, ada 4 jenis Filing Basis yang Anda dapat pilih. Kami akan ulas masing-masing pilihan yang dapat Anda pertimbangkan, tergantung dari situasi bisnis Anda di Amerika Serikat:   1. Use in Commerce Basis Jika Anda sudah melakukan penjualan produk ataupun jasa di Amerika Serikat, maka Anda dapat mengajukan permohonan Merek Anda di Amerika Serikat dengan menggunakan “Use in Commerce Basis“. Dalam situasi ini, maka Anda harus menginformasikan kepada The United States Patent and Trademark Office (USPTO) mengenai tanggal pertama kali Anda menggunakan Merek tersebut dan bukti penggunaannya di Amerika Serikat. Jika Anda bergerak di bidang kuliner/makanan dan minuman, maka katalog, brosur, iklan, invoice, kemasan, dan Bill of Lading dapat digunakan sebagai bukti penggunaan Merek (Specimen of Use).   2. Intent to Use Basis Jika Anda belum menggunakan Merek Anda di Amerika Serikat, maka Anda tetap dapat mengajukan permohonan Merek menggunakan “Intent to Use Basis”. Dalam hal ini, maka permohonan Anda akan diproses secara normal, namun setelah terdaftar (10-12 bulan dari tanggal permohonan), Anda wajib untuk memberikan bukti penggunaan Merek yang kami telah uraikan dalam poin pertama, yang akan dituangkan dalam Surat Pernyataan Penggunaan Merek (Statement of Use). Jika Anda belum siap untuk memberikan Statement of Use, maka permohonan perpanjangan waktu dapat dilakukan setiap 6 bulan untuk 3 kali. 3. Foreign Registration Basis Jika Merek Anda telah terdaftar di negara lain, maka Anda dapat mengajukan permohonan Merek Anda dengan “Foreign Registration Basis“. Dalam hal ini, Anda tidak diwajibkan untuk mengajukan Statement of Use kepada USPTO agar Merek Anda dapat didaftarkan. Untuk jenis permohonan Merek ini, Anda diwajibkan untuk memberikan bukti berupa sertifikat pendaftaran Merek di negara lain, beserta terjemahan dalam Bahasa Inggrisnya. 4. Foreign Application Basis   Jika Merek Anda telah diajukan permohonan Pendaftarannya di negara lain dalam 6 bulan sebelum mengajukan permohonan Merek di Amerika Serikat, maka Anda dapat mengajukan permohonan Merek Anda dengan “Foregin Application Basis“. Dalam hal ini, informasi tambahan akan diperlukan oleh USPTO untuk mendaftarkan Merek Anda, seperti Statement of Use di Amerika Serikat.   Untuk pertanyaan lebih lanjut mengenai permohonan pendaftaran Merek di Amerika Serikat dan negara lainnya, silahkan hubungi kami di [email protected].
