Patent: New Official Fees Introduced for Additional Procedures
Unlike the Trademark system, Indonesia’s Patent fee revisions are relatively limited. The new official fees for several additional Patent actions that previously did not have dedicated fees. These include:
- Request for substantive re-examination of a Patent application that has been voluntarily withdrawn by the applicant.
- Request for substantive re-examination of a Simple Patent application that has been voluntarily withdrawn.
- Request for Early Substantive Examination, allowing applicants to accelerate the examination process.
The introduction of an Early Substantive Examination option is particularly noteworthy, as it provides applicants with an additional mechanism to potentially obtain Patent protection more quickly when commercial timing is critical.
Strategic Considerations for IP Owners
With these changes approaching, businesses should consider reviewing their Indonesian IP portfolios and filing strategies.
For Trademark owners, it may be worthwhile to:
- accelerate planned Trademark filings before 2 August 2026;
- review upcoming renewal deadlines;
- complete pending recordals involving assignments, licenses, or ownership changes where appropriate.
For Patent applicants, the newly introduced procedures provide greater procedural flexibility, particularly for applicants seeking to revive certain applications or expedite examination.
Looking Ahead
Although official fees are increasing for many Trademark services, the revisions also reflect Indonesia’s continued efforts to modernize and strengthen its Intellectual Property administration.
For businesses investing in the Indonesian market, timely filing and proactive IP management remain far more cost-effective than delaying protection until disputes arise.
