However, for Trademark owners facing the risk of counterfeit goods entering or leaving the country through import or export channels, that protection can be further strengthened through Intellectual Property recordation with the <strong>Directorate General of Customs and Excise (DGCE)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Through Customs recordation, information on Intellectual Property Rights and the identifying characteristics of genuine products is entered into the Customs database. For recorded Trademarks and Copyrights, the DGCE can implement an ex-officio mechanism, enabling Customs authorities to proactively take measures such as detention, temporary suspension, and physical inspection of goods suspected of infringing Intellectual Property Rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This mechanism has become increasingly relevant, particularly following Customs\u2019 clarification that, since 2025, proactive detention of goods suspected of infringing Intellectual Property Rights can only be carried out if the Trademark has been recorded in the DGCE system. The recordation process is free of charge and is valid for one year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>For further information on the procedures and requirements for Customs recordation, read our previous article, \u201c<a href=\"https:\/\/affa.co.id\/global\/2026\/08\/26\/the-benefits-of-ip-customs-recordation-for-your-ips-in-indonesia\/\">The Benefits of IP Customs Recordation for Your IPs in Indonesia<\/a>\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, are more Trademark owners actually making use of this mechanism?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Data published by the DGCE through its Customs Recordation Dashboard for the period from 2022 to 2026* reveals a particularly interesting trend&#8230;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Recordations Jumped from 3 to 42 in Just Three Years<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2022, the dashboard recorded only 3 recordations from 2 companies, namely 3M Indonesia Importama and Standardpen Industries. The 30 recordations recorded in just the first eight months of 2026 have already reached approximately 71% of the total recorded throughout 2025.<\/li>\n\n\n\n<li>Since 2026 is not yet over, the current figure of 30 still has the potential to surpass the 42 recordations recorded in 2025. On average, approximately 3.75 recordations per month were recorded from January to August 2026, slightly higher than the 2025 average of 3.5 recordations per month.<\/li>\n\n\n\n<li>This indicates that demand for Customs recordation continues to grow.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Enforcement Actions Are Rising Even Faster<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The growth in Customs recordations becomes even more significant when compared with the IPR enforcement data presented on the same dashboard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The number of enforcement actions recorded was:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>2022: 4 enforcement actions<\/li>\n\n\n\n<li>2023: 3 enforcement actions<\/li>\n\n\n\n<li>2024: 5 enforcement actions<\/li>\n\n\n\n<li>2025: 15 enforcement actions<\/li>\n\n\n\n<li>January\u2013August 2026: 27 enforcement actions<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">While the number of enforcement actions remained within the range of 3\u20135 cases per year between 2022 and 2024, it jumped to 15 in 2025, before reaching 27 enforcement actions by August 2026. In other words, the number of enforcement actions recorded during the first eight months of 2026 was already 80% higher than the total for the entire year of 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compared with 2022, the number of enforcement actions recorded through August 2026 was already nearly seven times higher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These figures do not necessarily prove that the increase in Customs recordations is the sole cause of the rise in enforcement actions. Various other factors may influence enforcement activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, there is an important practical connection: the more Trademarks are recorded, and the more comprehensive the information on genuine products available to Customs, the greater the information base Customs officers can use to monitor goods suspected of infringing IPRs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DGCE itself has stated that increased Trademark recordation helps Customs officers conduct monitoring and take preventive action before counterfeit goods enter the market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Class 3 Has Become One of the Most Actively Recorded Classes<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data also reveals an interesting shift in the types of goods being recorded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2022, recordations were distributed across Classes 9, 17, and 16, with one recordation each. In 2023, Class 5 ranked first with four recordations, followed by Class 8 and Class 3* with three recordations each.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since 2024, however, Class 3 has become particularly prominent:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>2024: 12 out of 21 recordations<\/li>\n\n\n\n<li>2025: 13 out of 42 recordations<\/li>\n\n\n\n<li>January\u2013August 2026: 12 out of 30 recordations<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">*) Under the Nice Classification, Class 3 includes various products such as cosmetics, toiletries, perfumes, and cleaning preparations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prominence of this class makes sense from a border protection perspective. Consumer products such as cosmetics and personal care products are widely traded across borders, serve mass markets, and rely heavily on product authenticity to maintain brand reputation and consumer trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another interesting development is the increasing diversification of recorded classes. In 2022, recordations covered only 3 classes of goods, while in 2025 and January\u2013August 2026, the number had increased to 10 classes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This suggests that Customs recordation is increasingly being utilized by Trademark owners across a broader range of industries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Major Companies Are Taking Customs Recordation More Seriously<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The list of companies with the highest number of recordations also indicates that this mechanism is becoming more than just an administrative facility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2022, 3M Indonesia Importama recorded two recordations. In 2023, PT Glaxo Wellcome Indonesia and Paragon Technology and Innovation each recorded four. Paragon subsequently ranked first in 2024 with 10 recordations, while recording another five in 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2025, other companies among the leading recordation holders included <strong>PT Rajapet Pasti Sukses<\/strong>, <strong>Unilever Indonesia<\/strong>, <strong>PT Shimano Batam<\/strong>, and <strong>Schneider Electric SE<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As of August 2026, <strong>PT Beiersdorf Indonesia<\/strong> ranked first with 11 recordations, followed by <strong>Cipta Sinergi Asia<\/strong> with four, alongside several other companies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of these companies conveys an important message: Customs recordation is increasingly being treated as part of Trademark portfolio management and a proactive anti-counterfeiting strategy, rather than merely as a response after infringement has already occurred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why Should Trademark Owners Consider Customs Recordation?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the main challenges with counterfeit goods originating overseas arises once those goods have already passed through the border and entered domestic distribution channels.
