Effective 1 August 2026, Jersey will <\/span><span style=\"font-weight: 400;\">no longer be automatically covered<\/span><span style=\"font-weight: 400;\"> when applicants designate the <\/span><b>United Kingdom<\/b><span style=\"font-weight: 400;\"> in an international Trademark application.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Instead, Jersey will become an independent designation under the Madrid System, requiring applicants to specifically select Jersey if they wish to obtain Trademark protection there.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>What Is Jersey?<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Jersey is a self-governing <\/span><b>British Crown Dependency <\/b><span style=\"font-weight: 400;\">located in the <\/span><b>Channel Islands<\/b><span style=\"font-weight: 400;\"> off the northwest coast of <\/span><b>France<\/b><span style=\"font-weight: 400;\">. Although it has a population of just over 100,000, Jersey is a well-established international financial centre with significant banking, investment, agriculture, and tourism industries.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Many international businesses maintain commercial interests in Jersey, making Trademark protection in the jurisdiction increasingly relevant.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>What Is Changing?<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Until now, designating the United Kingdom under the Madrid System automatically extended Trademark protection to Jersey.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">From 1 August 2026, this will no longer be the case. Applicants filing a new international application, a subsequent designation, or a renewal must separately designate:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">United Kingdom; and\/or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jersey.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Selecting the United Kingdom alone will no longer provide Trademark protection in Jersey.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Why Does This Matter?<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The change is particularly important for businesses that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">operate in Jersey;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">plan to expand into the Jersey market;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">license their Trademarks to partners in Jersey; or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">wish to prevent third parties from registering similar marks there.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Failure to designate Jersey may leave Trademark owners without protection in the jurisdiction.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Declaration of Intention to Use<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Applicants designating Jersey must declare that they intend to use the Trademark, or permit its use, for the goods and services covered by the international registration.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">This declaration will be incorporated into the relevant Madrid System forms.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Jersey Will Have Its Own Office of Origin<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">From the same date, Jersey-based applicants will file international applications through the<\/span><b> Jersey Registrar of Intellectual Property<\/b><span style=\"font-weight: 400;\">, which will become Jersey&#8217;s own Office of Origin under the Madrid System.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>What About Existing International Registrations?<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">For international registrations that designated the United Kingdom before 1 August 2026, WIPO will automatically record a designation for Jersey.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">However, if the UK&#8217;s refusal period has not yet expired, WIPO will wait until the UK grants protection before recording the Jersey designation.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">If protection is ultimately refused or invalidated in the United Kingdom, WIPO will not record the Jersey designation.
