Now You Can Request Official Takedowns in Indonesia"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Trademark and Copyright infringement on marketplaces, social media, and websites is not a minor issue in Indonesia. Despite frequent warnings, illegal content distribution, counterfeit product sales, and unauthorized use remain easy to find. Often, enforcement struggles to keep pace with the growth of infringements\u2014take one down, and many more appear in its place.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The good news is that the Indonesian IP Office &#8211; <\/span><b>Directorate General of Intellectual Property (DGIP) <\/b><span style=\"font-weight: 400\">now provides an official mechanism to request the takedown of infringing content, listings, accounts, and even entire websites. This mechanism is expressly regulated under <\/span><b>Minister of Law Regulation No. 47 of 2025<\/b><span style=\"font-weight: 400\"> on the <\/span><b>Handling of Reports of Intellectual Property Infringements in Electronic Systems<\/b><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This means that Trademark owners, Copyright holders, and other Intellectual Property (IP) rightsholders no longer have to remain passive in the face of digital infringements.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>What Is the New Solution Under This Regulation?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Under this regulation, IP owners or rightsholders may submit an official report to DJKI for suspected IP infringements occurring on:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Marketplaces\/e-commerce platforms<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Websites<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Digital media operating through electronic systems<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Including live streaming content<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">If the report is deemed to meet the elements of infringement, DGIP may recommend access termination, which may include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Removal of content (takedown of listings);<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Account suspension; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Partial or full blocking of a website.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">This is an official administrative pathway provided by the state, not merely an internal platform mechanism that may be unavailable or inadequately implemented.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Types of Intellectual Property Protected<\/b><\/p>\n<p><span style=\"font-weight: 400\">This regulation applies broadly and covers all IP rights protectable in Indonesia, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Trademarks<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Copyright and Related Rights<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Patents<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Industrial Designs<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Trade Secrets<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Layout Designs of Integrated Circuits<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Geographical Indications<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Communal Intellectual Property<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">As long as the rights are registered or recorded with DGIP, this mechanism may be used.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Who Is Entitled to Submit a Report?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Please note that reports may only be submitted by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Registered\/recorded IP rightsholders with DGIP; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">IP licensees whose license agreements have been recorded with DGIP.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Reports may be submitted directly or through an authorized representative, such as a <\/span><a href=\"http:\/\/affa.co.id\"><span style=\"font-weight: 400\">trusted and reliable IP Consultant<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>How to Submit a Takedown Request<\/b><\/p>\n<ol>\n<li><b>Prepare the Report Containing the Following Information<\/b>\n<ul>\n<li><span style=\"font-weight: 400\">Identity of the reporter;<\/span><\/li>\n<li><span style=\"font-weight: 400\">Type of IP infringement;<\/span><\/li>\n<li><span style=\"font-weight: 400\">Website address, platform name, account, or content link being reported;<\/span><\/li>\n<li><span style=\"font-weight: 400\">Brief description of the alleged infringement; and<\/span><\/li>\n<li><span style=\"font-weight: 400\"><span style=\"font-weight: 400\">Additional information related to the infringing goods\/services.<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Attach Mandatory Supporting Documents<\/b>\n<ul>\n<li><span style=\"font-weight: 400\">Proof of IP ownership (e.g., Trademark certificate, Copyright recordation, etc.); or<\/span><\/li>\n<li><span style=\"font-weight: 400\"><span style=\"font-weight: 400\">Proof of recordation of the IP license with DGIP.<\/span><\/span>Without these documents, the report cannot be processed.<\/li>\n<\/ul>\n<\/li>\n<li><b>Administrative Examination by DGIP<br \/>\n<\/b>After the report is received, DJKI will conduct an administrative examination:<\/p>\n<ul>\n<li><span style=\"font-weight: 400\">If the submission is incomplete, the reporter will be given up to 14 business days to complete it.<\/span><\/li>\n<li><span style=\"font-weight: 400\"><span style=\"font-weight: 400\">If the deficiencies are not remedied within this period, the report will be deemed withdrawn.<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Substantive Verification by the DGIP Verification Team<\/b><span style=\"font-weight: 400\"><br \/>\n<\/span><span style=\"font-weight: 400\">If the report passes the administrative stage, DGIP will form a cross-sector Verification Team (involving DGIP, relevant ministries, associations, and\/or experts). The team will examine the substance of the alleged infringement and may request information from:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Electronic System Operators (ESOs); and\/or<\/span><\/li>\n<li><span style=\"font-weight: 400\"><span style=\"font-weight: 400\">The reported party.<\/span><\/span>Verification timeline: a maximum of 3 business days from the date the report is recorded.<\/li>\n<\/ul>\n<\/li>\n<li><b>Recommendation for Access Termination<br \/>\n<\/b><span style=\"font-weight: 400\">If the infringement is confirmed, DGIP will:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Issue a recommendation for partial or full site closure or access termination; and<\/span><\/li>\n<li><span style=\"font-weight: 400\"><span style=\"font-weight: 400\">Submit the recommendation to the relevant digital authority or directly to the ESO.<\/span><\/span>The recommendation must be delivered within 1 x 24 hours of being signed.<\/li>\n<\/ul>\n<\/li>\n<li><b>Special Provision for Live Streaming Infringements<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400\">For infringements occurring via live streaming, the verification and recommendation process is expedited to a maximum of 1 x 24 hours.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><b>Can Access Be Restored After a Takedown?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Yes, subject to certain conditions, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Authorization or cooperation from the IP owner\/rightsholder; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A settlement agreement resulting from mediation with the reporter.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">A request for restoration must be submitted to DGIP and will undergo a further review process.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">With this newly regulated mechanism, trademark owners, creators, and other IP rightsholders now have an additional, effective option for enforcement, beyond court proceedings and internal marketplace complaints.
